do we contact the court or let them deal with brother?


Brother returns to court May 4 for his trial. My mother & I have reason to believe he was raped while in college (things he's said in the past). My mother's psychologist recommended that she send a letter to the court asking for mental help for my brother - told mother she could even give her name, etc. My brother has expressed to us (before court gave us a no contact rule) that he's afraid if we get involved things will get worse for him. Should we make one last attempt to contact the court to ask for help? My mother called me tonight to ask what she should do. I told her to think about it and do whichever she'd be able to live with. Not doing anything and brother not getting help (if in fact he did have trouble years ago) or contacting court and maybe making things worse for brother in terms of the law. Any suggestions?

It sounds like you gave her good advice.  She should do what she can live with.  I don't know how the court system works really, but I don't see how a letter could hurt his cause.  I could be wrong though!

I don't know if it could make things worse or not. I don't see how.


If your mother's psychologist recomended it, maybe her best bet would be to speak further with him or her. Possibly the psychologist has dealt with situations like this before with the courts and would know the legal ramifications of it. Since she has probably discussed the situation with the psychologist, I doubt they would have suggested something that would cause more harm. I would think the worst that could happen is that even if the court refuses to give him the help he needs, a letter from her would be on record stating that he might need it. that could only help in the future.
