As some of you know I have been complaining about my landlady,who refuses to address a mold problem.My daughter was back at the doctor yesterday,another course of antibiotics,this is week 3 of severe allergy related symptoms.I have moved her away from the mold,her bed is now in my living room.Well I called legal aid and I do have options,option 1 is I no longer have to pay rent because landlord failed to provide a safe environment,but I have to move out.option 2 is don't move out and don't pay rent and give written notice that you are moving out if these things aren't fixed which they say is difficult because they usually get mad and treat you badly from then on.option no.3 basically a long and arduous court case. I have the text messages from her acknowledging the mold problem,I have text messages of her instructing us as to how to do the clean-up and others refusing to repair things, so I am covered.I am thinking option 1 as our relationship is now deadlocked and I have basically been told to move out, I have that text also.What do you think.I have never withheld rent before and I feel awkward about it but I think I have the right.They did advise moving out because the landlady may retaliate.
I'm a bit concerned that even if you move out, you will be charged for back rent, security deposit and any anticipated rent that you didn't pay because you moved out before your lease was completed? I can also see her charging you a cleaning fee and taking it all to court where a judgment in her favor can result in your paying court costs, too, with a blip against you on your credit report. Of course, she can still charge some of this even if you do live there until July. I'd still pursue any organization in your area that handles Tenant/Landlord disputes if there is one?
Do they have a small claims court where you live? Sometimes the best route is to be proactive, sue her before she sues you. The process is relatively simple, and designed so you don't have to have a lawyer. It could take #3 down to a short and simple court case.
I agree with Kenny. If you stop paying rent, she can treat you badly and not fix anything. If you go to court, she will hopefully be forced to fix the problem.
This is a difficult decision as my goal is to have peace and stability in my life,I have made several commitments to myself and one is no chaos.My life has been total chaos and drama for so long , and I have started this new journey,I have made a lot of changes already and I don't want to overwhelm myself.I think I will pray and meditate on this one.
