my brother returns to court today for his pretrial


Please God get him help! Im starting to wonder if the court system actually helps people or if its just there to enforce the law. Its going to be a long day for our family.

I know how you feel.  My husband has to go to court tomorrow for a dv charge.  I asked the magistrate when he was arrested to order him into treatment.  He told me that only the curcuit court judge could order it.  My husband called for help yesterday and has an appointment tomorrow morning with a local treatment center.  I am still going to request court ordered treatment so he doesn't have a chance to change his mind.  The courts don't seem to want to help change people, just seek justice.

I wish you both well with your court situations.  You both posed the problem of courts offering help to those in need.  Unfortunately, it does not happen all that often any longer.  Courts are hesitant to get involved in these situations.  The courts find it hard to sentence someone to rehab knowing that for the most part it does not work.   They have discovered as many of us have that unless the offender is willing to get help on their own - any court ordered mandate will not work.   The onus is put on the families and the responsible parties to get help on their own.  The job of the courts is to adjudicate the offenses by the laws at hand. 


I know its not the answer either of you wanted to hear and I'm sorry if these truths cause you any pain, however, being informed about what can happen is giving you the power to make your own decisions.

I was once involved in making a court mandate a person to have treatment.  They did.  It didn't work.  I should have learned then that it was up to them.  Now I know.  If someone wants treatment they can pretty much get it.  Otherwise they can certainly do everything they can to make the rest of us their wardens.  I'm not really willing to take on the warden role in life anymore.  I am sorry your family is having to deal with this.  Maresie.
