Just some questions.... responses greatly appreciated


I have questions that may sound silly but I am curious and when I'm curious, I ask!

If an individual that is employed is an alcoholic, gets sent to detox then to rehab are they entitled to disability benefits? Are they entitled to resume their employment position when the get out of rehab? What if they continuesly go through these cycles? Does the system allow them to collect disability and resume working at their place of employment?

Disability takes a long time to get, and usually not without an attorney after the first denial. I applied in August of 2007, and just had my court hearing on the 16th of last month, and still haven't heard back.

It is very hard to get disability.

I'm not sure what you mean by disabilty, social security?

There are of course tons of people with liver failure (caused by alcoholism) who get treatment and disablity so it depends on the case. 

People used to be able to get social security for alcholism. That is a lot harder now but alcoholics do become disabled and sure they get disablity. The kind of stuff you are describing is called non compliance and lots of people do that.

Public health deals with lots and lots of people who do stuff that kills them, look at smokers are they denied coverage, nope.

I think it depends on the employers and the benefits they offer.  My company has very generous benefits.  Tim's employers did too.  The only issue for him was that after he went into detox, the place where he wanted to go into rehab had a 6 month waiting list.  So he didn't go.  After we married he went on diablility because he had other issues.  His doctors did not want him to go back to work due to his feet.  Check with the employers and social security.  The laws can vary from state to state.

Just to clarify my previous question of eligibility for disability benefits:  if someone falls off the wagon, has no other conditions other than that they drink, gets busted for DUI, stuck into a detox then goes away to rehab is disability justifiable?  Remember, there are NO other conditions justifying a disability.  No liver issues, no mental issues, just the consequences of being busted for DUI.

To me, this doesnt seem like a justifiable reason to be put on short term disability.  They drank, got busted, on their own will went into detox for a week and choose to go to rehab (all probably in an attempt to 'look better' in the courts before their sentencing for the umpteenth DUI)

Hopefully this is clearer.

[that being said, under the facts as you laid them out, I doubt that the A would be entitled to state/federal short term disability.  However, the A may have short term disability coverage that would be determined by the terms of the policy]

I am interested because I found out through a friend that my ex applied for short term disability with the state~and the state approved it.  I think that is the most ridiculous benefit for an A.  He drinks, screws up, and gets to collect disability because he's an alcoholic with NO OTHER MEDICAL problems.  No wonder this country is in the position its in.  Do they give disability benefits to heroin addicts so they can buy more drugs?  If they're going to pay him for being an alcoholic, they may as well let him keep his license too! 

On a more positive note, I AM DOING GREAT!  My boyfriend and I are heading to historic Mystic CT for the weekend for a relaxing, exciting time.
