It has been almost a year since I moved out of the house and there is a one year waiting period for filing for divorce in NC. I am dirt poor and am wondering if anyone has any resources for attorneys who might possibly give a tidbit of direction in what I need to do to file for divorce. I am wanting to find out if there is any way to include custody/etc. without a separation agreement or if I can file the divorce with my attached proposed separation agreement and have that entered in the judgment? AH is currently in jail and will be easy to serve! I just need a little direction and have no $. Thanks for any help, I'm in the Wilmington area if anyone knows anyone!
I think you can go to the courthouse and talk to one of the clerks about paperwork. You don't need an atty to file for you, you can do it yourself. Check online for some resources there as well. You may be able to download forms you need and google "legal aid" in your state and see what comes up.
http://www.legalaidnc.org/Programs/Offices/Wilmington/default.htm Here you go. This is a free attorney. Let them know that he is gone. If they can not do it for free, they will put you in touch with a pro bono attorney. You can also go to any office max and get the paperwork there. You can also go to your family court services and they teach you how to file your own paperwork. Good luck.
one thing I would say having gone the legal aid route on a recent matter. Get more than one opinion.
If possible speak to an attorney. Give them as much documentation as you can.
One resoource for you might be the domestic violence agencies. They may have an attorney who works with them. Get as many opinions as you can and then file the paperwork dont' be in a hurry and think its all sewn up. Law is complicated.
I cannot offer any advice in this area.....as I researched it a year ago myself and found NO HELP w/out money. What I did find was a way to file an uncontested divorce here in VA at roughly $1000 after all was done. My initial consultation fee of $150, my separation/divorce papers to sign for $395 and actually filing w/the courts through my lawyer for $450. I know you can do all of this paperwork on your own for free and file w/the courts for a small court filing fee. That is all I know. Good luck in your search.
