Looking for some practical info. AH got a DUI a few weeks ago; our auto insurance agent is now trying to get ahold of him. I"m guessing they're going to cancel our insurance, or at least raise the rates.
I don't give a flip about AH's coverage at this point, but I really need to have affordable insurance coverage. Ours is expensive already since AH was in an accident last year and we made a claim (drunk of course, but didn't get caught). Any resources/personal experience on what my rights (if any) are in this situation, or if there's any course of action I can take to protect myself? TIA!
if your A has his license revoked or suspended, then going to a new carrier (would recommend Farmer's, Progressive, or even Geico) and have a policy in your name only as the only named operater of the vehicle. and then I'd keep it that way, regardless of multicar discounts and the like.

I recently had a conversation about this with an attorney. He advised me that since my AH's name is on my house that I need to make sure that he is covered by auto insurance. NOT enabling, protecting my assets. If he makes a bad choice, gets in an accident etc. and the car is not insured then there is nothing but the house to go after. I was not expecting this answer, I had planned to let the insurance coverage go, his tough luck not mine. Having turned to a "power greater than me" in this case an attorney, I found that my thinking was in fact distorted and that in order to protect myself, not him, I need to either 1. get his name off the house, or 2. pay the insurance if he doesn't. I don't like either option but I don't like this disease either. On to Step 3 with this one.
Sharky - I have thought about this one many many times over the past year. I just bought a house in my own name and got new homeowners insurance through a different company than we had w/the previous house. Now, in order to get a lower rate, I transferred my auto over too. I did this for me & my AH. However, in the last 3 weeks since doing this, my AH has gone on 2 separate 1 week disappearances acts (binging) and I have decided to move forward w/separation. So before paying my 1st large auto insurance premium, I had him removed from my policy. They would only do this however with proof that he had another policy already in place. (that sucks) Luckily for me, I hadn't cancelled our other policy yet. So now I am having him removed from my new one and removing myself from our original one. I plan on giving him his bills when he shows up and letting him know he has until Feb 15 to get a payment to his insurance company or his policy will be cancelled do to failure to pay. Then I won't have to worry with it.
I am not sure what your exact situation is but I hope that my experience has helped you in some way. Sincerely, QOD
Oh I have the auto insurance issue. The A is on the truck ownership. Its a long long story and one I have told too many times. I have to in time (probably next month) up the policy for better coverage. I used to resent the hell out of the A over this now I am watching my resentments. I think its a long long hard road for some of us to get separate. I know it is for me.
regardless of who is on the title, your insurance company only deals with LEGAL drivers in the household. ownership should NOT be an issue with insurance -- if it is, maybe time to find a different company.

I took the ultimate step Sharky. I am not advising this, but it worked for me. I divorced my A! I purchased another home after the divorce which is in my name only, and I separated our auto insurance. Had his vehicles put in his name only and my vehicles put in my name. By taking these drastic steps, I have relieved myself of any financial and legal responsibility resulting from his actions. We are still together, but now I feel like the weight of the world has been lifted. As an aside, he always talked about wanting to refuse to pay federal income taxes. Now when he mentions that, I say, "Do whatever you want," knowing that I cannot get into trouble for his decisions.
My attorney had advised me that while we were married, I was equally and severally liable, and believe me, I had a LOT more to lose than he had.
Good luck to you, Diva
